這個行為標(biāo)準(zhǔn)比美國法律上一般的過失責(zé)任標(biāo)準(zhǔn)要高,不僅要求以一個"謹(jǐn)慎"(prudent)的專業(yè)人員的行為為標(biāo)準(zhǔn),而且還要求以一個"合格"(well-qualified)的專業(yè)人員通常和習(xí)慣的(ordinarily and customarily)行為作為標(biāo)準(zhǔn).
